Research On The Scope Of Government Information Disclosure During Emergencies

Due to the economic and social restructuring and other reasons,more than 10 years before the 21st century becoming the peak of all kinds of unexpected events,emergency response capacity to emergencies test of the government’s ruling ability and level.Due to sudden emergencies, unpredictable, destructive characteristics, they have an immense impact on psychological state of the vital interests of the public.If the public can not be the first time to receive the truth of emergencies, all kinds of rumors will spread quickly,cause additional harm to emergencies easily,cause social instability generated, increase the government’s handling emergencies difficulty.Therefore, the government released timely, complete, accurate and true information emergencies and for strengthening the public sense of crisis, to assist the government in coping with unexpected events,these measures can play a positive role.At the same time protect the public’s right to know, to increase the government’s credibility and image of the country for the construction of democracy and the rule of the government to provide a strong support.In the information disclosure system of the building and practice we have made some progress,"Emergency Response Law"and "Regulations on Open Government Information"and other series of emergency norms were introduced, for china’s emergency treatment to provide the system guarantee,succeeded in guiding the "5.12" earthquake emergency information such as public work.But we should also see, there is no law level of information disclosure law, the lack of legal system and the administrative concept of unity behind the obstacles, the Chinese government in the emergency information disclosure for not doing enough, this paper will be divided into five parts to carry on the discussion to this problem.Part I is an introduction, which explains the background,current research,significance,and research ideas of this article.The second part is the analysis of theories related to the scope of the disclosure of government information in emergencies, this paper introduces the connotation of related concepts, the theoretical basis, and the range of government information disclosure and emergency exceptions doing the sort.The third part is the extraterritorial application of national regulations on information disclosure scope of unexpected events,Lists, such as America, Britain, Japan and Sweden, approaching in public emergency information on representative countries for reference and bringing enlightenment of our country.The fourth part is the extent of public emergency information, investigation of the current situation of the present situation and the legislative status quo through practice, analying the problems and reasons in the scope of information disclosure.The fifth part is to improve the information disclosure of emergencies range of suggestions,through putting the right to the constitution,clarifying the basic principles of the scope of government information disclosure,refining of the terms of the scope of government information disclosure in emergencies,establishing a sound system of the legal system, increasing the relief system and other aspects to elaborate.Through the above analysis of the recommendations,I hope this artical can serve as a reference for the improvement of emergency information disclosure range.
