People—oriented Thought And Its Contemporary Value In Chinese Traditional Legal Culture

Chinese traditional legal culture has been a hot topic which the scholars of legal theory researched, and "people-oriented thought" is both one of the extremely important part and distinctive feature in Chinese traditional legal culture. It is also a ideological proposition that is worth exploring further with the social changes and the development of the times. People-oriented thought originated in the turn of the Shang and Zhou, and developed in the Spring and Autumn period. It generalized Chinese ancient thought of "people are the foundation of the country, people-based" ideology of generalization. As the important part of Chinese traditional legal culture, it played a guiding role in Chinese ancient politics and legal practice. But it is undeniable that there is both dregs and essence in Chinese traditional legal culture, and we cannot analyze simply from a surface or one dimension. According to the thinking of Marxist historical materialism and dialectics, analysis and judgment proposition should be multi dimension, so is it on "people-oriented thought" of the Chinese traditional legal culture. At present, there are many scholars research subject of the people thought at home and abroad a lot, which have high quality, but there are still many scholars’ understanding of the thought of the people is not deep enough, they even confused the concepts in Chinese traditional legal culture of people-oriented thought and humanism, humanitarianism, and Western democratic thought concept. This paper combs the legal culture of the ideological content of the Republic of China, the context of the historical development of ancient legal system and China influence of purpose, connotation and essential attribute is clearer, thorough analysis of the thought of the people.Since the founding of the party and new China, we repeatedly stressed that "people be in power", "serving the people" to people as the main body thought importance. Although the current social background, economic foundation and many other factors and China ancient society has undergone tremendous changes, but Chinese culture itself contains the thought of people on the current Chinese social development, especially has the extremely profound significance and important role in building socialist rule of law Chinese characteristics. China is at a critical stage of reform and development, we should emphasize the importance of the thought of "people-oriented ", especially in the comprehensive promotion of the process of rule by law is more important to people as a source of legal authority. Chinese traditional “the people thought” has played an important role in advancing the process of rule by law, scientific legislation, strict law enforcement, the judicial justice and the rule of law education and other sectors.
