Research On Emission Of Maritime Greenhouse Gases Under GATS Environmental Exceptions

With the explosive development of science and technology, output around the world has a general improvement as well. According to closer link of countries, human economic activity and world trade has gradually got rid of the geographical limitations, while transportation that we rely on has also been an unprecedented scale across the globe. As to the surroundings that provide strong support for trade and transport experienced a great shock, environmental issues are no longer a local problem of a single country or particular region. Issues originally belong to the trade and circumstance in the different field of two become more acute under the globalization of economic and environmental problems, research on exception clauses of WTO and legislation of China at this time have the important significance.The combination of service trade and environment problems has become the most hot topic in the field of international trade and environmental protection, legal systems of international and domestic shipping service to be perfect is not only the basic needs of WTO, is also the basis of the overall ecological environment protection, so research on the combination of environmental exceptions and China maritime law in the present stage is necessary. As a developing country, shipping legislation of China within trade and environment problems is more complex than whenever and whoever, as the coordination-environmental exceptions in GATS should balance the shipping services and environmental theory, furthermore provide legal advice to China.According to the current shipping service and legal theory to reduce greenhouse gases, the article divided into three parts from the international law and domestic law, made systematic research on legal issues include environmental exception clause of GATS under the sea forward to reduce maritime greenhouse gases. The first part first introduced the basic content of environmental exception clauses, partly from four aspects of the legal characteristics that based on the general agreement on tariffs and trade. The second part of which is about GATS environment exception clauses for shipping services and the influence of the maritime industry, from the positive impact of green trend to shipping services, and negative impact that green trade barriers from the United States and the European Union. The third part from the article introduce problems related to legislation, relevant principles of international law were applicable in different international conventions, consideration of embodied carbon responsibility, maritime legal supervision problems. Above all the article hope to give corresponding countermeasures and appropriate advices for questions has been put forward.
