Since the founding of new China, institutions of housing reform have been released. Housing system in our country has changed and developed so many times. Housing reform system indeed contributed a lot to solve people’s housing issues in that specific condition. Owning to the tension between supply and demand, housing prices rising unceasingly, which change the house character— "necessities" gradually becomes a "luxury", people have to suffering the soaring house prices. Therefore, Chinese government issued a number of housing security system to ensure the housing needs of people, one of the most important is the system of affordable housing. At the early stage of the system operation, it played an indelible role in improving the housing environment of low-income families. But, there are access and exit defects behind the institution, and the government ignores some issues, its supervision also weakly. The loophole will be slipped through, which contrary to the original meaning. Meanwhile, the academic circles began to discuss whether to abolish the system of affordable housing. In order to improve the institution of affordable housing, and find out the defects of the system, since 2006, our country has carried out affordable housing of property rights in 6 regions through the nationwide. The system has already implemented a nearly nine years. When the good results were brought out, inherent flaws in the system also exposed. As our country is drafting the Housing Security Law, the system of affordable housing will be reflected in the law. So it is important to research and analyze the defects during the implementation of the system.This paper is divided into four main parts:The first part, mainly on summary and analyze the law policy, institutional and legal basis of the current affordable housing system, in order to find the defects of the system, enhance the implementation of the affordable housing of property rights.The second part, based on the empirical survey data, especially analyze the affordable housing system in Huaian city, Jiangsu province and Shanghai, then research details of its implementation. During this process, some doubt and questions in the system will be found out.The third part, back to the UK, the United States or other countries with mature regulations of property right system, analyze the origin and development of their property rights,, thus to solve the problems in the process of implementing this system in our country, make the better overseas law "localization".The fourth part, combining the issues in the pilot city with reference of overseas law, based on the original system, which including housing access and exit mechanism, the allocation of property rights, the rights and obligations and so on.The institution will be improved through the original system and the author’s idea, thus it will have profitable effects.
