| Recent years, more and more teachers’ rights are infracted. At the same time, teachers’ right protection consciousness gradually enhanced. But few colleges and universities have established a workable school appeal system of teachers. When teachers’ rights are infringed, the teachers and university can only through the judicial process to solve problems. The school appeal system of teachers is based on the constitution of our country, and which is made for the teachers to protect teacher’s rights. Eighth session of the Fourth Plenary Session emphasized governing the country by law, the university also be governance by rule of law. The establishment of appeal system in the school has important practical significance.This paper divided into six parts, the first chapter is introduction; it mainly analyzed the background of this research, the definition of the key concepts, the literature review, the significance and the method of this research, and the relevant theory of the college teachers’ appeal. The second chapter mainly analyzed the nature, features and functions of the appeal system from the perspective of law. The third chapter mainly analyzed the university Charter of73universities; understand the basic situation and problems of teachers’ appeal in colleges and universities. The fourth chapter mainly studies the present situation of teachers’ appeal in Taiwan and United States, in order to provide inspiration for the appeal system of our university. The fifth chapter is mainly put forward the suggestions for improving the appeal system of teachers in universities, further clarified the relief way of teachers’right in universities. The last part is conclusion of this paper, summarized the research conclusion, the research insufficiency and the prospect. The establishment and perfection of appeal system of college teachers will play an important role for maintenance our teachers’ legitimate rights and interests, guarantee the academic freedom, and reduce the cost of justice. |
