Reflection And Perfection Of The System Of College Students' Appeal In China

In recent years,due to the violation of the right to education of students or because the students are not satisfied with the school misconduct caused by the college and students in the proceedings occur.The establishment of College Students' appeal system plays an important role in safeguarding the legitimate rights and interests of college students,effectively resolving the contradiction between the school and the students,and maintaining the normal teaching order.At the same time,the establishment of College Students' appeal system has attracted the attention of the education department.In 2005 the introduction of the provisions of the management of students in Colleges and universities on the college students to make a complaint system.Especially the new revised and will be put into practice on September 1,2017 "ordinary college student management regulations" chapter of the college students' complaints were provided,and effectively promoted the development of the complaint system for college students.However,due to various reasons,there are still many problems in the practice of the construction of College Students' appeal system in our country.The existence of these problems has restricted the development of the system and the improvement of the legal system.It is of great significance for us to learn from the successful experience of foreign and local college students' appeal system,to reflect on the current system of our country and to improve it.Think of the appeal system for college students is conducive to students' rights respected and protected,is conducive to resolve conflicts and disputes,to alleviate the pressure of the school,to implement the rule of law,the idea of the rule of law,promote the legalization of school management.However,there are no uniform rules for the establishment of the appeal institution,the lack of operational procedures,and the absence of the right to appeal.Learn from the experience of construction of University complaints system in USA and Taiwan,China should follow the basic principles of university student appeal system,strengthen the creation of auxiliary system,the implementation of the new "Regulations" uniform rules;at the same time to clear qualitative complaint handling decisions,make good decision and complainthandling complaint inside and outside school review administrative appeal cohesion,guidance and supervision to strengthen the implementation of the complaint system.
