Concerning The Improvement Of University Teachers' Appeal System In China

Education is the foundation of national rejuvenation,higher education as the highest stage of education,so the importance of the priority development has been generally recognized by the whole society.University teachers as the main undertaker of educational activities in colleges and universities,the role of evangelization mission has always been known for the people.Nowadays,in the era of increasing demand for knowledge,the role of teachers in colleges and universities is becoming more and more prominent,and the protection of their rights needs to be concerned.It is not only an effective measure to safeguard the rights and resolve contradictions,but also an important legal system of the state.Based on the current situation and the problem-oriented,comprehensive and detailed examination and study of the university's appeal system in China,this paper uses the methods of data analysis and comparative research.The first part of the article bases on comprehensively promoting the background of administering the university according to law and administrating according to law,emphasizing the significance of perfecting the system of appealing for teachers in colleges and universities.On the basis of deep understanding of the intension and characteristics of the college teachers 'appeal system,this paper reveals the value of rule of law in the system of teachers' in-school appeal to protect the lawful rights and interests of teachers,supervise administration according to law and balance the relationship between teachers and universities.The second part of the article based on jurisprudence,administrative law,based on a comprehensive analysis of the construction of university teachers in China the legal basis of the appeal system.First of all,the legal relationship between colleges and teachers and diversified,not only the existence of subordinate type of administrative legal relationship,there are equal rights of civil legal relationship.Secondly,the diversification of the legal attributes of the teachers' appeal system in colleges and universities is not only the nature of internal administrative relief,but also the nature of administrative adjudication.Finally,the system of university teachers' appeals reflects the diverse requirements of the rule of law,including the rule of law,the right to relief,procedural justice.The third part of the article to college teachers in our country the status of the complaint system for the focus,combing the teacher's complaints system exists legal problems.Mainly because the complaint handling organization is not clear enough,the scope of the complaint is not clear,the complaint procedure is not perfect,the relief channel is not expanded after the appeal,the supervision and enforcement is weak five aspects.The fourth part of the article is problem-oriented,and puts forward the way to perfect the appeal system of college teachers in our country.On the basis of the successful experience of the college and university teachers 'appeal system in the United States and Taiwan,the author puts forward some feasible suggestions for the perfection of the university teachers' appeal system in our country.First,clarify the status of the complaint handling organization,improve the staff disposition of the complaint handling organization;secondly,clarify the scope of the appeal on the basis of delimiting the types of disputes between teachers and colleges;secondly,perfect the appeal process and procedures system,Finally,from the aspect of perfecting the responsibility,giving the department the authority to supervise and executing,and relying on the teachers and students to carry on the supervision and execution,etc.,The author puts forward some suggestions on how to solve the problem of the administrative appeal and the administrative reconsideration.Start,strengthen supervision and enforcement.
