Research On Farmland Development Rights From The Perspectiveof Ecological Law

Farmland development right is an important right system of land rights, and it is of great significance for protection of farmland and ecological environment and the protection of farmers’ land rights. China has a large number of practice related to the farmland development rights, but we has not explicitly put forward this concept, has not set up system of farmland development rights, there are no statutes to apply, cause of the destruction of agricultural land and ecological environment. Therefore, from the perspective of ecological law, this paper carry on the research of farmland development rights, to provide reference for the creating of farmland development rights that comply with the requirements of the ecological protection. From the concept, nature, classification, the source, elements and the relationship between the farmland development rights and the other rights, the paper explains the basic connotation of farmland development rights and combines the basic theory of farmland development rights. In order to protect farmland, natural resources, ecological environment and social public interests, western countries have established a more perfect farmland development right system. Our country should according to the specific conditions and basic land system, drawing lessons from the foreign system of farmland development right theory and experience, combining with the practical background of the construction of main functional zones, establish and perfect the system of farmland development rights in view of the ecological environment problems in the practice. Through the analysis of the ownership of farmland development rights, the effects of the whole running process of farmland development right on the ecological environment, the paper will propose corresponding regulation measures and system design and regulate the farmland development right exercise and transaction, to arouse the enthusiasm of farmland ecological environment protection of farmland development rights subject and make the creating and running of the farmland development rights more in line with the requirements for environmental protection.
