Legal Protection Of The Financial Consumers’ Privacy

With the constant extension of the contents of the financial service the consumption of the financial service has become one kind of important consumptions. The protection of the financial consumer privacy is closely related to the interests of the consumers and plays an important role in the maintenance of the financial market stability.This paper analyzes the legal protection of the financial consumer privacy and is composed of three chapters.First, the author solves the basic problems of financial consumer privacy. To begin with the analysis of the consumer’s meanings in the Law of the PRC on the Protection of the Rights and Interests of Consumers and explore the question of the relationship between the actors in the financial market and the consumers in this law and make sure that it can be defined as consumer. And the author analyzes the distinction between the financial consumers and the common consumers and the financial investors. Then the author defines the concept of the financial consumer privacy and analyzes the extension and its specific contents of its four functions. At last the author analyzes the relationship between the financial consumer privacy and the common privacy.Second, the author analyzes how the financial consumer privacy is violated and international comparison. At the same time the author classifies the phenomena of the violations of the financial consumer privacy by the financial institutions. To solve these problems effectively, the author probes into the legal system of the U.S.A and the E.U and gets some revelations from them for these revelations would provide us with some references in the future perfection of the system of the financial consumer privacy.In the third chapter, the author makes suggestions on how to improve the legal system of the financial consumer privacy on the base of the deficiencies and the revelations from the U.S.A and the E.U.
