Probation, as a non-custodial sentences, is a system of non-performing the original sentence with some certain conditions. Applying the probation for slight crime, educating and overseeing the criminal with the strength of the society can avoid the shortcomings of short-term free sentence, at the same time, reserve the possibility of execution of the penalty, so the criminals will be constantly alert to prevent further crime and the loss of freedom for crime, then we will achieve the purpose of special prevention of the penalty. Given the advantages of probation in the conservation of judicial resources and educating, saving, transforming the criminals, the states attach great importance to the application of the probation system worldwide.Subject to heavy punishment in our state, the criminal policy of "Hard-Strike " and the defect of the probation system on the legislation, judicial system and other factors, there are many problems on probation. By studying the Criminal Law Amendment (viii) and the influence of the community corrective measures for implementation of probation, the writer try to figure out the problems of application of probation in our state and make recommendations to the Perfection of Probation system.
