With the rapid development of the socialist market economy, air transport industry in the country as a transport infrastructure integrated transport system in the status and role are constantly improved. Since reform and opening, China’s civil aviation industry has developed rapidly, the industry have been expanding significantly improve the level of safety, service capabilities gradually, as China’s reform and opening up and socialist modernization drive has made outstanding contributions. However, China’s civil aviation industry to meet the growing demands of the public, but also constantly exposed many regulatory issues. For example: the legal system is imperfect safety supervision, safety supervision and actors are not standardized, market supervision lacks effective supervision mechanism, safety supervision and lack of effective economic sanctions, etc. These constraints have become the bottleneck of sustainable aviation industry. Therefore, to enhance and improve the civil aviation industry regulatory theory and practice is increasingly becoming a major issue in one attractive.This article from a legal point of view, by studying the current development of China’s civil aviation industry, regulatory and security that exist on the basis of market regulation issues, learn from the United States, Canada and Japan aviation industry regulation and law enforcement experience, to speed up the construction and improvement of China’s civil aviation industry in the regulatory system of the four suggestions that improve aviation regulators to further strengthen the legal system; strengthen the supervisory authority; establish compensation system for the protection of public interest; strengthen supervision personnel training, and gradually improve regulatory standards. Rationalization by presenting these proposals to compensate the lack of development of the aviation industry, and strive to build a high-speed and stable development of the civil aviation market of free competition.
