Research On The Flow Of Personnel And Intellectual Property Protection

Technological innovation is regarded as the core strength in national development, playing a vital role in improving the social productivity and overall power of the country. To maintain the vitality of technological innovation requires enhancing the protection of intellectual property. Universities are becoming the pioneers of innovation, involving actively in the production, dissemination, promotion and transformation of scientific and technological patents. Along with the deepening of reform and social progress, university staff flow is more frequent, resulting in the brain drain together with research achievements, termination of scientific programs, impairment of intellectual property and low rate of patent transformation. Therefore, universities have to come up with a mutual beneficial resolution, both enhancing mobility of intellects and protecting intellectual property rights.This paper clarifies the background and significance of the university staff mobility and intellectual property protection. It further analyzes the purpose and innovation of university staff flow and protection of knowledge, and then describes the intellectual property concepts, management characteristics, the channels of brain drain and the dialectical relationship between them. Through a typical case, this paper analyzes the current situation of intellectual property protection of Chinese universities, pointing out a number of issues of intellectual property protection in Chinese universities at present. Based on the experiences of intellectual property management of universities in the United States and Japan, this paper makes some proposals for the universities of our country on staff mobility and protection of intellectual property, including awareness of the protection of university intellectual property, rules and regulations, the flow of personnel management and the introduction of internal "transfer system" and so on.
