On The Application Of The Society Service Order In China

When searching for alternative short-term imprisonment penalty, society service order gained support from most western countries, and also widely used by many countries. In 2011, China has stipulated community correction as imprisonment, but still didn’t clearly state the extremely important form: society service order. But under current international society trend of light punishment and non-imprisonment punishment, China is quite necessary to further explore this system.This article is mainly based on our country’s experimental work, draw lessons from foreign society service order system and try to find a way which is suitable for China. Therefore, this article takes related theories as foundation, explores the necessity and feasibility of system applicable in our country and proposed own view on constructing this system. Totally 3 parts as follow:First part is about the concept and the development of society service order,mainly states the concept of society service, and then introduces its origin and development, after understanding the basic theory of analysis of the regional social service system, and the obstacles existing in the society service to apply in China, and tries to find out social service system in foreign countries, finds out those can help our country’s development of the social service system.Second part is about meaning of putting society service order into practice in our country. This article clarifies this extremely necessity by its background and positive affection, meanwhile, explores the possibility of society service order in China through our country’s experimental work.The third part is about whether the idea of society service order is suitable for our country or not. This part defined the nature of community service order by analyzing its basis, form, subject of publish community service order, then to improve the regulation of punishment in our country. This part is the main purpose and key to this article.
