On The Impacts And Countermeasures Of Justicial Openness Of Judicial Authority

The judicial openness is a constitutional principle in China, and is also a basic litigation system, is the basic guarantee and important way to realize judicial justice. In recent years, The judicial openness has made some achievement since people’s courts at all levels attached more importance to it, it gradually developed a wide-ranging, and various means judicial system. But the trouble with this, get rid of the "mysterious veil" judicial work will stand the public concerns? Whether the present judicial team really has the ability to completely after public pressure? The judicial openness will enhance the authority of the court, or makes the judicial authority which already fragile hit be a further blow in this era of the government credibility is low. The judicial openness brings to the judicial authority is not do more harm than good, or vice versa? These problems now have to face. The author working in the judicial system feels more natural and confused these problems. This paper is through the author’ current work practice, in reference to the current country a lot of work and research results, on the basis of theoretically expounds the concept and meaning of open justice, also to make objective evaluation of the judicial openness system on the impact of the judicial authority and the game relationship between the two, and to explore how to make both better fusion and to achieve a goal- everyone believe in law.The first part of this article mainly introduced the current practical situation of our country’s judicial openness and it gives the impact of the judicial authority with the advancement of the judicial openness. The second part, there provides game relation of judicial openness and the judicial authority, on the one hand, open justice can prevent judicial injustice, improve the judicial authority, on the other hand, open justice can also weaken the judicial authority in the current judicial system. The third part, mainly discusses how to promote judicial authority under protection of the judicial openness---leveraging from the judicial openness and safeguard judicial credibility.
