On The Legal System And Mechanism Of College Students’ Patent Commercialization

Along with the economic globalization and the advent of the era of knowledge economy, the intellectual property rights has become the core resources for the national development and international competitiveness. In 2008, our country issued the outline of the national intellectual property strategy, which marks the intellectual property strategy become the one of the most important national grand strategies. At the end of 2012, the party clearly put forward that scientific and technological innovation is to improve the strategic support of social productive forces and overall national strength, which must be placed in the core of the national development and global position, stressing the need to adhere to the road of independent innovation with Chinese characteristics, implement the strategy of innovation driven development. Under the situation of that knowledge economy has become dominant economic form of the 21 st century, as an important strategic measure to catch up with the knowledge economy era, our country proposed the strategy of national innovation system. And innovation is the key talent, the future talent is the key to college students, college students as studying object of patent achievements, present situation and the bottleneck problem, through the analysis of the empirical study intends to propose solutions to the construction of an innovative country and the implementation of the strategy of intellectual property rights has very important significance. This article will focus on to improve college students’ patent transformation ability and level of the concrete implementation plan of the system suggestion and platform construction, has important practical value.This research used the literature methodology, the empirical analysis, comparative analysis, etc. First of all, using literature research, for college students’ patent achievements related to conduct a comprehensive collection of literature study, analysis and review; Secondly, based on the empirical analysis on the part of college students in Wuhan city patent commercialization case,using interview method and statistical analysis method, comparison method is used to illustrates the basic status of college students’ patent commercialization, resolve the bottleneck in Chinese college students’ patent achievements; Finally, using the method of induction, statistic analysis, empirical study on Chinese college students’ patent achievements required legal mechanism, supporting policies, studies the education system and market system, and comprehensive system of the construction of college students’ patent achievement transformation platform.The innovation point of this study is to adopt the method of literature research and empirical analysis, to our country the status of college students’ patent commercialization and facing the bottleneck to conduct a comprehensive analysis; Referencing the revising law, from the law, policy, college system, market system four aspects to cultivate college students in our country patent system construction achievements transformation and to patent achievements of multidimensional platform.
