On The Community Correction Of Juvenile Delinquent In China

Community correction is a non-custodial sentence, which is an internationally developing trend of criminal system. Juveniles is the hope of our country and nationality, But now the minor crime is increasingly serious. Considered the physical and mental development of minors, juvenile community correction turns out gradually. Our country since 2003 the pilot work of community correction special legislation there still exist the blank. In Criminal Law Amendment Ⅷ, community correction for juvenile offenders is paid special attention to. And it is also concerned by more and more scholars. This paper mainly about juvenile community correction, then analysis the present situation and disadvantages. Then based on the basic theory of juvenile community correction, and reference the other countries whose system construction is better.First part is about the present situation of juvenile community correction in China, analyzed the current legislative and practical situation of juvenile community correction, then on the basis of the status to sum up the shorts of our country’s current juvenile community correction.Second chapter of the basis of the theory about community correction, provided theoretical support for our country’s juvenile community correction.Third part briefly introduced the practice of community correction for juvenile offender of extraterritorial Application. Emphasis on several typical countries, analyzes their juvenile community correction system, it will provide experience of juvenile community correction system for our country.The fourth part is proposes some suggestions on how to constructed, and put up own some viewpoints, which is about the relative juvenile community correction.
