Countermeasure Research To Improve The Leadership Of Chinese Communist Party On Judicial Work

The “decision” passed in the Third Plenary Session of the Party ’s eighteen stated clearly that we should focus on upholding the party’s leadership, the idea that people are the masters, deepening organic and unified reform of political system and rule by law. The “decision” also clear the guiding principles and policy of which deepen political system reform. The Fourth Plenary Session of the Party’s eighteen definited the overall goal further that it promote the rule by law comprehensively:found the legal system having socialist of Chinese characteristics. To achieve the overall goal, the premise is sticking to the leadership of the Communist Party of China. Judicial reform is the important part in the political system reform and the process in building judicial system having socialist of Chinese characteristics. This reform must uphold the party’s leadership. However, for the party’s leadership to the administration of justice, there are still a lot of difficulties at this stage. How to strengthen and improve the party’s leadership to the justice work is the great and urgent task for the governing capacity of our party.This paper is based on the concept that the party lead the judicial work and discussed the necessity that the Communist Party of China led the administration of justice from the three aspects that is historical choice, content of governing and requirements of the people. Secondly, the paper described the development course respectively of the party’s leadership to justice work and summed up the experience which the party gained in the leader to justice work. Then, the paper analyses the shortage of the party’s leadership to the justice work and its reasons at three aspects that party’s leadership and independence of judiciary present tension, government functions to be confused with judicial functions, the gap between judicial capacity and expectations of the people. Finally, aiming at how to strengthen and improve the party’s leadership in administration of justice and from multiple perspectives, for example the party’s leadership, judicial system reform, social supervision, the paper offers some proposal and suggestions to promote the party’s leadership in the administration of justice.
