Study On Ecological Restoration Legal System For Mining Environment

Mineral resources are very important for the development of our country. For a long time, the lack of environmental awareness, the lack of rational planning, and the blind pursuit of GDP lead to a lot of problems, such as serious damage to the natural environment and ecological system, and the crisis of survival. The construction of ecological civilization was mentioned in the report of 18 th Communist Party of China. That means the society should protect the ecological system and the environment. So it is the right time for ecological restoration work. However, the practical effect about the laws of ecological restoration is not ideal. How to reduce damage to the environment of mineral resources exploitation? How to maintain the public in environmental protection of rights? How to realize the sustainable development of the natural environment, the social economy and the human beings? With the deepening of reform and opening up, we need to solve these problems.This paper will try to find a way to perfect the legal system of ecological restoration of mining area, from a legal point of view. In order to solve the environmental problems caused by the exploitation of mineral resources. And find a balance between the protection of the natural environment and the promotion of social development. The paper is structured as follows:The first part starts from the concept of ecological restoration, and then come to the meaning of the legal system of ecological restoration of mining areas. The present situation of our country’s environment in mining area is discussed.The second part introduces the current situation of China’s legal system of ecological restoration in mining area. The paper reviews that in legislation and practice. And in this part, the legal system, financial system, supervision and management, the legal relief, public participation are analyzed. On this basis, the main problems of China’s legal system of ecological restoration of mining areas are shown. The legislative concept and the legal system are not complete. The supporting system is not perfect in the funding system and the public participation.The third part introduces the mine ecological environment restoration of the foreign countries. And try to put forward the experience for our reference.The fourth part puts forward the conception of perfecting our legal system of ecological restoration of mining environment. The work is not only in the legislation, but also in the supporting system, such as responsibility, standards, and funds. In this way we can realize sustainable development of mining area environment.
