The Study On Cash Deposit System Of Mine Ecological Environment Restoration

Large-scale development and utilization of mineral resources has great support the development of industrialization and modernization of our country. However, the rapid economic development has paid a high environment cost; the ecological environment of mine has been severely damaged. So in order to achieve sustainable development, we should change this situation and establish a set of perfect legal system of mine environment protection. The cash deposit of mine ecological environment restoration system is the guarantee and reserve funds which the mining-right owners pay to restore the mine geological environment according to some standards. It is an efficient way to protect and manage the mine environment and regain green mountains and rivers and build green mines.This thesis is based on the cash deposit system of mine ecological environment restoration is a necessary system. In the first part, I gave brief introduction of the cash deposit system of mine ecological environment restoration. Since the state of the relevant administrative regulations and departmental rules did not give this guarantee a precise definition, the description of the deposit in local rules of the provinces(cities, districts) also is not the same, so the name and concepts of the margin is not regulated. In this part, I analyzed the connotation of the system, showed how to determine the name of cash deposit, the definition and nature of cash deposit. Also I proved the rationality of the existence of this system.The second part is the investigation the history and reality of the cash deposit of mine ecological environment restoration system in China. I introduced how this system built and provinces in China, which based on the collected a large number of information and data. Also I compared the similarities and differenced between provinces in China.Based on the second part, in the third part, I analyzed and summed up the existing problems in the establishment and operation of this system, such as the management system is not reasonable, the collection form is too simple.In the fourth part, I gave some suggestions to perfect the system from the aspects of how to make the legitimacy of the system, clear management responsibilities, rich margin deposit forms and promote public information and public supervision and so on.In the future, the needs of mineral resources will increase, the exploitation of mine resources will casus the destruction of the ecological environment. The more exploitation of mine resources, more the protection and restoration of mine geological environment, so a perfect system of the cash deposit of mine ecological environment restoration will play an important way in it.
