| In recent years,with worsening temperature and deteriorating environmental condition, each nation wishes to come to an agreement to protect the earth.However, a restrictive and multilateral agreement can’t be made,and it leads to some carbon tariff measures practiced by some developed countries to curb the carbon emission issue. This paper focuses on whether the carbon tariff issue caters to the requirements of WTO frame and the effects on China economy.This paper starts from the concept and feature of carbon tariff. Through the match analysis of the relation among carbon tariff and basic principle of WTO and the NO22 item of GATT, the legality of carbon tariff under WTO will be verified.And solutions to China’s solving carbon tariff issue can be come up with.This paper is divided into four chapters:The first chapter discusses the demarcation of carbon tariff system, making a comparison of carbon tariff and tariff and analyzing the concept and nature and feature of carbon tariff. All above provide a theoretical foundation and argument point to analyze the legality of carbon tariff.The second chapter focuses on the relationship between carbon tariff and WTO basic principles.Via the concrete research on the basic three principles of WTO, the question whether carbon tariff is legal or not under the three principles can be solved.The third chapter unfolds on the relation between GATT’s number 22 item and carbon tariff.By analyzing the foreword of number 22 item of GATT and item b and item g deeply,the conclusion whether the legality of carbon tariff exists under these three factors can be drawn.The fourth chapter, on the perspective of China’s attitude and strategy over carbon tariff, analyzes the domestic and international effects the carbon tariff exerting on China and China’s attitude towards it. By virtue of the analysis of China’s domestic and international strategies towards carbon tariff, the suggestions of settling the carbon tariff issue are put forward. |
