"Controlled Delivery" was originally stipulated in the Convention of United Nations Against Illicit Traffic In Narcotic Drugs And Psychotropic Substances, and is evolving constantly, becoming a kind of new effective means on drug crime, corruption crime, and any other new type of crime. It’s the first time that controlled delivery shall be approved by Criminal procedure law of our country which admits its legal status. But during drug crimes investigation, the implementation of control delivery still exist practical difficulties.First, Criminal procedure law is lack of corresponding regulation and constraints to control the delivery under. In the practice of the drug crimes investigation, Controlled Delivery is frequently used by the investigation organ and, causing the judicial and legislative faults, disconnection between theory and practice. Second, our country has not established an independent jurisdiction of investigation system, so the investigation jurisdiction is based on jurisdiction system. Due to the particularity of drug crimes, result in the new jurisdiction problems in drug crimes investigation. Third, the importance of investigation activity and the particularity of controlled delivery put forward the higher requirements to investigation personnel to carry out evidence collection activities. Finally, under the current legal system, direct evidences are in parallel with the parallel evidences. The lack of evidence transformation rules create space for illegal evidence into legal evidence.Therefore, this paper research on the applicable of the controlled delivery on drug crimes investigation.It is hope that through the analysis of theory and practice, can put forwards effective suggestions to check the power of investigation and restraint application of controlled delivery on the drug crimes investigation, consisting improvement of relevant laws relating to controlled delivery, system of supervision to investigation, system of internal control and protect the rights of suspects.
