Research Of The Confidentiality Examination System In The Publicity Of Government Information

The methods of literature research, comparative analysis and content analysis were used in the article.By analysis of the present situation and existing problems of the confidentiality review mechanism,the article discussed the perfect path for it. The perfect path about the principles and the subject, scopes and standards, methods and procedures, responsibility and remedy and other angular.In the actual work,there are many problems in the system.Such as the subject of confidentiality review is too wide meaning and the process does not have a unified standard,which makes it lack of standardization.Other problems are also serious,such as lack of confidentiality review supervision and guarantee responsibility and remedy paths are not clear.The first part of the article is an overview of the government information disclosure confidential censorship.The main contents about a brief overview of the theoretical basis and legal basis and the establishment and development process of confidential examination system in China.The second part,puts forward to establishing an authorized system and joint review system,for the problem of subject is too wide meaning.Third part puts forward to further standardizing the concept and scope of the state secrets and unified the standard of commercial secrets, personal privacy and the administrative organ work.The fourth part according to the problem of confidential examination examination way non-standard, this paper expounds the elements method and information segmentation method in processing of the concrete application of the exception information.Fifth part for the problem of confidentiality review lack of responsibility and relief system does not reach the designated position, put forward that the complete confidentiality review responsibility system should at least includes: administrative punishment, administrative liability and criminal liability of three parts,and established the government information publicity "confidential examination committee" in our country,to make up for the insufficiency of government supervision and behavior of the internal confidential examination and deficiencies.In the appendix part, based on the article content and the full analysis of the current local government secrecy examination system established a confidential examination system of government information openness, hoping to be able to expand the article practical significance.Through the above six parts,the article tries to have a relatively complete observation and understanding about the confidentiality review mechanism of government information disclosure in China.Hoping the article can play a reference and promoting role in the future legislative work about the government information disclosure confidential examination.
