Since the 21 th Century, the number of international migrants has become larger and larger.The international migration issues have led to a worldwide social attention, both in terms of theory and in terms of system design and practice, in which the protection of international migrants’ rights has become the focus of people’s attention.The main point of this paper is the protection of the international migrants’ right to education in the European Union. There are mainly two kinds of the international migrants: the internal migrants and the external migrants. Firstly, this paper discusses the meaning of protecting the international migrants’ right to education through a brief introduction to the concept and nature of the right to education and other basic theories. Secondly, through the analysis of the basic EU treaty, the secondary legislation, the judicial precedents and the national legislation, this paper sums up the core principles of protecting the international migrants’ right to education in the EU: the principle of equality and non-discrimination which includes non-discrimination, fairness and multicultural education. Thirdly, by analyzing the European international migration system from three aspects: the access to the education system, the social welfare system, and the multicultural education system, the author finds that the mechanism of protecting the internal migrants’ rights in the EU is relatively perfect, while the protection of the rights of the external migrants is far from enough. Finally, the author focuses on the issues on protecting the rights to education of the overseas Chinese in the EU, studies the characteristics of the new overseas Chinese, analyses the current situation of the overseas Chinese in education from the higher education and basic education, and puts forward some suggestions on how to protect the overseas Chinese’s right to education from three levels: the European Union level, the national level and the community level.
