Research On Legal Regulation Of Beidou Satellite Navigation System

Global navigation satellite system is an important content of outer space activities, which makes the human activities in the field of outer space extend. At the same time, it is important for safeguarding national security and promoting economic development and also improving social life. Countries will develop their own satellite navigation system that is a symbol of national’s comprehensive power. China’s government also focus on developing and disseminating Beidou satellite navigation system. In order to promote the development of the Beidou satellite navigation system, government developed the policies that ensure the application of Beidou satellite navigation system and form its own market. However, with the development of Beidou satellite navigation system, the service scope expands unceasingly, lots of problems, such as the lack of legislation, policy operability, compatibility and interoperability, and user privacy protection are continuously emerging. To some extent, it hindered the construction of Beidou satellite navigation system and its industrialization process.This paper mainly studies the problem that domestic legislation of the Beidou satellite navigation system. At the present China legislation about it is blank. So the legal basis of this problem is mainly the United States’ and Russia’ policies and regulations respectively about GPS, GLONASS system. Through analyzing the pros and cons of domestic legislation, There is a conclusion that domestic legislation should be based on the characteristics of system and national conditions.Based on the comparative method and comprehensive utilization of inductive method, This paper combed the Russia and the United States satellite navigation system of policies and regulations. And it analyzes the industrialization of China’s Beidou satellite navigation system development present situation, tries to illustrate the problem as follows:(1) U.S. and Russian satellite navigation policies and regulations have its own characteristics. And it will find out which is superior.(2)Considering China’s legal system and the style of the Beidou satellite navigation system, specifying domestic legislation feasibility and necessity is particularly important.(3)In reference to legislation of Russia and the United States, we should put on reasonable legislative suggestions which can promote the construction and operation of Beidou satellite navigation system, and also industrialization development.
