The Research Of China’s Civil Aviation Government Regulation Reform

Civil aviation transportation industry-- the traditional monopoly industry, is an important part of civil transport development in China. Government regulation is an important task which is encountered by all countries at present. China’s civil aviation industry regulation reform has important affect not only to the interests of the people and sustainable developments of civil aviation enterprises, but also to achieve the goal of strengthen our nation by developing civil aviation industry.Since China’s reform and opening up, the civil aviation industry has always been an important industry in the economic and social development. With China’s rapid economic development and infrastructure gradually improved, China’s civil aviation industry has made considerable development and achievement. From the core indexes, such as safety management, industry scale and service, we found that civil aviation increased its proportion in the integrated transportation system in China significantly, driving other derivative industries. Civil aviation made outstanding contributions to China’s reform and opening up and socialist modernization construction, in the mean time our international status in civil aviation industry has been raising. However, civil aviation is not only a national strategic leading industry, but also an important way to adjust the economic structure and accelerate the transformation of industrial structure. Due to its capital intensive barrier, the civil aviation are more easy to centralization and monopoly compared to other industries. In addition, there are also some problems emerging along with the development of civil aviation industry, such as incomplete management system, imbalance and uncoordinated of different areas due to unscientific management system, improper allocation of resources between overall and local airspace, supporting facility like infrastructure lags behind, lack of professionals, enterprise competitiveness is not strong, etc., and some of these problems have become important factors restricting the sustainable development of our civil aviation industry. Therefore, government regulation is requested so as to protect public interests. With the "Several opinions of the State Council on promoting the development of the civil aviation industry" formally promulgated in July 2012, and the reform of economic and political system requested in the party’s Third Plenary Session of The Eighteenth, the best opportunity for the civil aviation administration, airlines, airport, air traffic control and other civil aviation industries to adjust their structures is coming.In this paper, through the research on the development of government regulation of China’s civil aviation industry, it analyses the problems in civil aviation development which was under the government regulation, and try to find out the solutions for the reform of the civil aviation regulation by using the typical analysis, comparative analysis and inductive analysis. It proposes suggestions and measures to improve the civil aviation’s operation mechanism, including strengthen the construction of legal system, complete our civil aviation industry related laws and regulations, specify the regulation system, strengthen guidance of the control, strengthen regulate and control ability, strengthen implementation ability for the regulation and control policy, do both in deregulation and supervision, etc, so as to achieve Pareto Optimality in the development of civil aviation in China.
