Beginning in the 1990 s, Antarctic tourism business has rapidly developed. Antarctic tourism is a completely heterogeneous than other modes of travel: not by direct government management or major funding, no host country or travel destination, without any direct travel managers or travel service facilities, needn’t to stimulate local economic development. Furthermore, Antarctic tourism is related to Antarctic claims, discourse power of Polar Code legislation and Antarctic expedition order. Antarctic tourism transport is mainly carried out by vessels, and thus brought the Antarctic ocean navigation safety and environmental safety issues, therefore it is important to discuss maritime legal regulation related to Antarctic tourism.This article mainly analyzed the international maritime law and domestic maritime law of four other countries to find that the current international regulations of Antarctic tourism are ineffective. By analyzing the trend of international maritime law development related to Antarctic tourism regulation, this article showed that the future of maritime regulation about Antarctic tourism depends on the Antarctic Treaty Consultative Meeting as the dominant force, Port State Control(PSC), IAATO and other international organizations to cooperate for the assistance, expanding the regulatory target to flag of convenience vessels phenomenon, non-party operators, etc. On this basis, this article draws out some suggestions about enriching our legal framework regulating Antarctic tourism and enhancing our discourse right on the Antarctic rulemaking.
