The Research On The Reform Of Land Enforcement System Of Shenzhen City

During the thirty-five years after Chinese Reform and Open, as an important carrier of social economy activity, the land has made important contributions to Shenzhen’s rapid growth. However, the fast and extensive urban development has consumed too much land resources, which generated a great number of illegal land uses and causes Shenzhen into the dilemma of urbanization. Shenzhen city has been attaching great importance to the land management for a long time. The city has resolutely punished the illegal uses of lands and restrained the illegal land use behaviors to some extent, which guaranteed the rapid growth. However, the city is also faced with the dilemma of invalid land enforcement, and the land enforcement system doesn’t meet the requirements of the new situation. To enhance the land enforcement and complete the land enforcement system has become an important agenda of Shenzhen City.On the base of reviewing the history of Shenzhen land enforcement system reform, this article summarized the status quo of Shenzhen land enforcement system, deeply analyzed the disadvantages of current Shenzhen land enforcement system and the causes of these problems, and offered several suggestions.This article consists of six parts.The first part is preface. It mainly introduced the background of the topic, the research meaning, and the research method. It summarized the current research of land enforcement, defined the two basic notions of land enforcement and land enforcement system, and pointed out the innovations and possible defects of this article.The second part reviewed the history change of Shenzhen land enforcement system, and briefly introduced the characters of the three stages of Shenzhen land enforcement system:department enforcement, urban manage generalized enforcement, professional enforcement.The third part summarized the current situation of Shenzhen land enforcement system from the aspects of the main body and its responsibility of land enforcement, the land enforcement procedure, and the land enforcement operation system, and thoroughly introduced the setting and features of three-level-enforcement team, the detailed stages of land enforcement and the content concrete of land enforcement system operation.The fourth part analyzed the existing problems of current Shenzhen land enforcement, including:poor management of professional enforcement team, overmuch land manage departments, distributed land enforcement power, imperfect land enforcement laws and regulations, bad connection between enforcement teams, and inadequate enforcement security.The fifth part analyzed the cause of the existing problems of current Shenzhen land enforcement system from the aspects of history, ideology, legislation and team building. The causes are long term inadequate focus on the land enforcement system, being not resolute enough to punish the illegal land use, lack concentration of the land enforcement team building, and the lagging land enforcement laws and regulations.The sixth part brought up several solutions and suggestions of how to complete the Shenzhen land enforcement system accordingly. These suggestions mainly include:to build a city vertical management land enforcement team, to complete the land enforcement laws and regulations, to properly divide the city street three-level enforcement team power, and to complete the common responsibility system of land management.
