The Research On The Performing Duties Ability Of The Representatives Of The Provincial People’s Congress

Since the eighteenth national congress of Communist Party of China(CPC), the party has made a series of claims about the People’s Congress(PC) system, whose position and role are increasingly important. Under the new situation, the study about PC system makes a lot of new achievements. Representative system is the key of the PC system, and it shows important significance in exploiting the advantages of PC system. But now, the extent of the representatives performing their duties is not enough, compared with the needs of PC’s work, the expectations of people, and the requirements of democracy and laws. Therefore, the study on the ability of representatives performing duties has become a hotspot in the research of PC system. By collecting the materials found, this research pays more attention to the basic and national representatives, less to the Provincial People’s Congress(PPC) representatives which are not the same with other levels. Therefore, this article is written according to the ability of the performing duties, taking Hebei province for example.On the basic of Collecting materials about PC system, this paper draws lessons from the western parliamentarism’s merits, absorbs the experiences of all the provinces, concludes the reality of PPC representatives performing duties ability, analyzes the reasons of the insufficient, and puts forward suggestions on improvement. It has positive practical significance in promoting the performing duties ability and the work of PPC. It can also do good to the representative theory and practice.This paper is divided into five parts.In the first part, the introduction discusses the background and value. The article combines the party’s new requirements to the work of PC, the changes of social environment, and the practice of representatives performing duties together, aiming at emphasizing the importance and necessity of this topic. It summarizes research status both domestic and overseas, generalizes the results, and lays the experience, literature, and theoretic foundation of the research, thus introduces the research contents and methods of this paper, as well as the innovations.Part two analyzes the related theories, providing theoretical basis for this paper, mainly referring to people’s sovereignty theory, the representative theory, and the representation theory. It introduces the viewpoints of western bourgeois scholars, classic marxism writers, our country’s scholars about democracy and representative theory, thus leads to the democratic form of PC system and the main aspects involved in.Part three analyzes the state in performing duties ability of Hebei PPC representatives, defining the meaning of duties, the main duties and responsibilities, the requirements and characteristics of PPC representatives’ ability in performing duties, finding out the deficiencies in and out of the session.Part four focuses on the reasons why the PPC representatives performing duties ability is low, and comes to the conclusions according to the analysis: Structure, identity and quality are important factors; less oversight, contact and securities all lead to the result.Part five puts forward the solutions based on the above mentioned reasons. This section considers controlling election is the premise, improving the comprehensive quality is the inner requirement, strengthening supervision is the external force, widening the link is effective measure, and innovating works is the important guarantee. Only by using more measures simultaneously shall improve the duty performing ability of PPC representatives effectively.
