The Research On The Perform Duties Of The RPC In Our Country

It is an important part of the National People’s Congress system of the PRC that the NPC deputies perform their duties effectively and legally, and this has essential meanings in both promoting the effective operation of the NPC system and ensuring the people to be the masters of our country. This thesis, based on the fundamental responsibility of NPC members and the characteristics of duty-performing, expounds profoundly the problems and the causes in the procedure of their performing duties, and explores practically for the improvement of their work.The thesis consists of the following four parts:The first part expounds the importance of the issue concerning the performance of duty of NPC deputies. In order to uphold and improve the NPC system, the representative system must be further improved and the role of the NPC members must be given full play to, to do which it requires the further improvement and implementation of duty-performing of NPC members, which is at the core of the representative system. An in-depth study of this subject is vital for enhancing the capabilities of people’s deputies (ideologically, culturally and professionally, to name but a few), the effectiveness of their work as well as for the perfection of the NPC deputies’ electoral mechanism. Further more, it also has vital significance in both improving the political position of NPC deputies and ensuring the people’s democratic rights to be masters of the country.The second part describes the basic duties of National People’s Congress deputies and their characteristics. The basic duties to be performed include upholding the party’s leadership, while exercising the power according to the law, actively performing their obligations on the people’s behalf, strictly abiding by the discipline and being present at meetings on time, strengthening participation in politics and focusing on investigation and study, strengthening learning and training to improve their own qualities, developing close contact with voters, and consciously accepting their supervision, etc. The overall features of the performance of the NPC deputies can be summarized in these four key words:for the people, legal exercise, procedural and protected.The third part points out the problems in process of their duty-performing, and analyzes the underlying causes. Combined with literature data and the opinions of experts and scholars, the current problems in the performance of NPC member’s duties are summarized as the following five respects in this thesis:the lack of enthusiasm to perform their duties, limited ability to perform their duties with poor effectiveness, lack of supervision and abuse of power, insufficient protection and bad environment of their duty-performing, not enough social understanding and poor establishment of authority, etc. The reasons, concluded through study, include the weak consciousness of the members which greatly influences their passions, poor overall personal qualities, inadequate supervision mechanism, insufficient protection of the performance and not enough social recognition and support needed to establish their authority, etc.The fourth part gives some tentative suggestions about the improvement of NPC member’s duty-performing system. First, we need to pay more attention to the deputies’ competence development, including strengthening the their consciousness as representatives of the people and of their representative obligations, strengthening their training through the establishment of the training mechanism, specifying the qualifications, optimizing the structure, proportion and the number of representatives. Second, we need to strengthen the supervision and standardize the supervision mechanism, including raising the people’s awareness for supervision and prompting the deputies to accept supervision, strengthening representative electoral supervision, standardizing the electoral supervision mechanism, and establishing the assessment system to supervise their performance. Third, we need to strengthen security, ensuring that deputies will be protected to do their work well, including the security in terms of time, as well as material safeguard, judicial guarantee to defend their legal rights, organizational safeguard, and service guarantee, etc. Fourth, we need to strengthen publicity and education to build a favorable environment, by stimulating the deputies’passion to perform their duties and the public’s willingness and awareness to support the deputies’work.
