The Case Study Of Star Endorsing False Advertisement

In recent years, the phenomenon of star endorsement false advertisement is so frequently,and litigation disputes is increasing.In order to regulate the growing phenomenon of star endorsement false advertisement,China’s newly revised "consumer protection law" in the clear for the first time the joint liability of star endorsement false advertisement.But because of the provisions of joint liability star spokesperson are too simple,and lack of operability,so can not be good to stop acts of false advertising endorsement.Besides China’s newly revised "consumer protection law",China’s "advertisement law" and "food safety law" from different angles to regulate false advertising endorsements.But from the practice situation,China’s existing laws exist defects is still in some places,leading to increasing the spread of false advertising situation is difficult to curb,so the relevant legislation in our country still needs to continue to improve.In order to solve the problem and to perfect the legislation of star endorsement false advertisemen legal liability,this paper based on three typical case of star endorsement false advertisement,summed up five main controversial focus in case,and extended five generally relates controversial problems in the case of star endorsement false advertisement,including the definition and standards of false advertisement,the current legal liability of star false endorsements behavior,the principle of imputation of star false endorsements behavior,the constitutive requirements of star false endorsements behavior and the compensation principle of infringing damage of star false endorsements behavior,and give a in-depth analysis of them.And then through the analysis of the legislation of star endorsement false advertisemen at home and abroad,search the defects of legislation in China’s current legislation on star endorsement false advertisemen and summarized what our country should learn from the place in legislation of other countries or regions.Finally, on the basis of previous studies,put forward three suggestions to perfect star endorsement false advertisemen legal liability,including perfecting the civil liability of the false advertising spokesperson,building the administrative liability of the false advertising spokesperson and seting up the criminal responsibility of the false advertising spokesperson,and hope to provide some help for the administration of China star endorsement.
