A Study On The Legal Issues Of The Use Of Police Firearms In China

As a kind of law enforcement tool, the gun has been the standard of police officers. It is also necessary and the country is equipped with the use of firearms, which is the work of police routine law enforcement work and work security. The characteristics of the state of the police system, which determines the legitimacy, necessity and rationality of police "fire power". But how to use firearms, when the use of firearms, the times, each country has a different view and understanding. How to make the police officer to use firearms correctly, scientifically and reasonably determine the scope of use, is the subject of legal research in each country. In order to make the police more effective and to improve the efficiency of police use, we must keep up with the current situation and establish the law and regulations for the use of police officers in China.In this paper, the use of the legal system for the use of police weapons has been the lack of the status quo, for the use of the legal system of China’s police weapon to improve the corresponding recommendations. This text is divided into four chapters, which are as follows. The first chapter is an overview of the new problems, the use of firearms related laws and police under the new situation facing the introduction. The second chapter discusses the theoretical basis of the use of police weapons. This paper mainly introduces the practical demand of police weapon and the use of police weapons, and discusses the legal nature of the use of police weapons. The third chapter on the police use of firearms laws exist problems were analyzed, including official gun regulations implement does not reach the designated position, business management at gunpoint rigid, use of firearms procedures is not clear, allowed and prohibited use scene fuzzy, the operability is not strong, the relevant law legislation level is too low, lack of necessary legal supervision system of relevant laws and regulations. The fourth chapter mainly introduces the system of police weapon in Germany, the United States, Japan, Chinese Hongkong and other countries and regions. The fifth chapter discusses the current situation and defects of the legal system of police weapon in our country, and puts forward some suggestions for improving the legal system. This part mainly analyzes the current situation and problems of China’s current legal system, and from the practice of the rule of law in China, the paper puts forward suggestions and measures to improve the system of police weapon use in our country.
