The Research On The Protection Of Consumer Rights In Network Transactions From The Perspective Of Governing The Country By Rule Of Law

In recent years, with the increasing popularity of the Internet in our country, the scale of the network is increasingly growing, which greatly promotes the prosperity and development of China’s e-commerce market and drives the trend of commodity trading network as well. Network transaction has many advantages that traditional transaction does not own, such as convenient transaction method, low transaction price and flexible transaction form. Along with the increasing popularity of online transactions, the new shopping pattern will bring great benefits to the social and economic development. However, due to the virtual trait of the network transaction, a series of problems will be inevitably caused in the practice of network transaction, which not only hinder the long-term development of the network, but has brought the real damage and serious threat to the large number of online consumers. By far new laws and regulations in our country has not been promulgated yet. Because of its scattering laws and regulations and its low practicality, it is difficult to form a sound system. Thus, it is difficult to protect the consumer rights of online consumers.Therefore, it is of great value, from the perspective of governing the country by rule of law, to discuss the particularity and necessity of network transaction rule of law, as well as the important significance of the rule of law in cyberspace. In addition, the protection of consumer rights exisits many problems in network transactions, such as the imperfect of legal system, the lackness of systematic regulation of online transactions and the abuse of formatic terms, etc. The proposal of the consumer rights protection system in the network transactions can aim at its defects to solve this problem so that it can make great contributions to maintain the legal rights of consumers. Specifically, we must strive to achieve the following three points: first of all, sound the legal system of consumer rights protection, improve the relevant laws and regulations and perfect the judicial relief system. Then, strengthen the protection of regulatory mechanism of network consumer rights and industry self-regulation and administrative supervision. At last, regulate the use of the formatic network transactions strictly, clarify the hint and instruction duty of operators, and give consumers reasonable cancellation right.
