The Analysis Of The Treatment Which Bases On The Environmental Psychology

After centuries of development, the punishment has become more moderate than it before. The treatment way of the state to the criminal has changed, but the attitude of the public to the criminal only varies from the large-scale public resistance to privately or industry sectors exclusion. High society crime, prison overcrowding, the effects of the rehabilitation of criminals in prison are not ideal. The main reason is that imprisonment leads to the criminal isolations from the social and the goal of the re-socialization is hard to achieve. After the criminals released from prison, their living and working conditions are lack of effective protection. Also, the biases from the citizens to the criminals always make them perplexed, thereby resulting in more crime. From the abolition of torture to imprisonment does not mean that the punishment is becoming humanized. Reversely, it just means that the control strategy has changed, and furthermore, it is not so effective to solve the crime problems. In order to prevent and reduce crime, ones need to rely on "grassroots", such as civil society organizations, communities and so on, to build a way of social concern and public participation. In order to study the criminal problems from the theoretical and practical aspects, the objective of this present paper is to discuss the value of the treatment on the basis of the Labeling theory and the Defensible Space theory which combined with environmental psychology. In order to reduce the crime, especially the rate of recidivism, ones must make full use of the social resources and the technologies if it is required to break the shackle of the old-maidish conceptions and to strengthen the cooperation between the government and non-government, to which the criminals and the society can be harmonically. It is worth noting that although the environment has an impact on the behavior of all individuals, the advocated Community Service and Electronic Monitoring of present paper is only applicable to the misdemeanant. The reason for using this word "treatment" instead of the word "punishment" is because that the punishment is based on the benefits of the victims and the society, irrespective of the interests of the criminals. However, the interests of the criminals are considered in the treatment to further reform the criminal and to make them adapt to social life. Compared with the punishment, the treatment is a higher-level requirement.
