Sentence to death above the law was commonin feudal society. At the same time, the penalty idea of cautious execution effects the ancient death penalty legislation. The emperors of Ming Dynasty were attach importance to legislation. Therefore, the death penalty was constant change in different stage.This paper bases on the death penalty about criminal legislation of Ming Dynasty. It is mainly used the method of comparative analysis to state the development and evolution of death penalty in Ming Dynasty. Accordingly, the research testifies the nature of death penalty legislation of Ming Dynasty.All paper is divided into four parts:Firstly, analysis the most important legal document of Ming Dynasty. Secondly, discuss the change of death penalty in laws and regulations of Ming Dynasty. Thirdly, expound the features and reasons of death penalty in the Ming Dynasty.The last part is peroration.This paper first describes the death penalty in Da Ming Law of Hong Wu 30 years, Wenxing Rules of Hong Zhi, Wenxing Rules of Jia Jing 29 years and Code of Great Ming Dynasty. Summarize the specific provisions of death penalty legislation in Ming Dynasty by analyzing the legal provision.The second part analysis the death penalty in laws and regulations of Ming Dynasty. Result shows the specific feature of Ming Dynasty.The third part, from the legislative characteristics of laws and regulations are complementary to each other and specific provisions of death penalty, reveals the features and reasons of the death penalty legislation of Ming Dynasty.
