Research On System Of Judge Selection Commission In Our Country

The court is the last defense line of social fairness and justice, while the judge is the patron saint.The judge as a profession is not only related to the country’s image, it also reflects the level of the rule of law to a certain extent. In face of embarrassment of the integral quality of the judges not going well with social development in our country, we need to accelerate the process of the reform of justice system, and be committed to constituting a good team of judges. The system of judge selection is the first step to become a judge. First of all, we need to reform the judge selection system, and there are three important problems to be clarified, in a word, these three aspects of the issue are all about the selection of judges.The introduction focuses on that theorists have reached an agreement on the design of the system, however, when related to the specific design of the system,there also exists different opinions. After all, the commission is a new thing in our country.The first part mainly describes the Necessity of constitution of the System of Judge Selection Commission. It includes the micro-layer and macro-layer, in an other words, the problems of judge selection and the requirements of new situation.The second part mainly discusses the advancement of the System of Judge Selection Commission in China. The state proposes to establish Judge Selection Commission in province level.Local government has also established Judge Selection Commission and released rules about the operation,composition, duties,and voting system of Judge Selection Commission.The third part mainly focus on the building of the system,including personnel composition, institutions,appointment subject, supervision and so on. First of all,when establishing the commission,we should follow the judicial law.Although it is necessary to refer to extraterritorial judge selection subject,we should also give full consideration of the situation of our country, and set up our system within the framework of the People’s Congress System.The last part discusses the system of external supervision, following-up practice and feedback, building consensus of judge selection. Things are interrelated. The establishment of Judge Selection Commission requires both internal coordination mechanism and a certain degree of external support. Reform is not easy, so we need to work"together" to construct a set of System of Judge Selection Commission system in line with China’s national conditions.
