| Since the labor law was born, the establishment and implementation of it has closely related to the legitimate rights and interests of the labor force in China, the importance is self-evident. In addition, since the beginning of the working class was subjected to various inhuman treatment and the hostile environment, therefore, the communist party has paid particularly attention to protect their rights and interests since the founding of it, the typical of which was Soviet area labor legislation. After the Soviet regime, the communist party made the policies and proposals, which were related to the protection of the working class, legal, enacted a series of labor law, and explored the method of safeguarding the workers’ rights and interests from the legal practice. The dissertation summarized the principles of the Soviet’s labor legislation, combed the content of the Soviet’s labor legislation, and discussed its characteristic and effect.The dissertation is divided into four parts. The first part is the principle of Soviet labor legislation. Through the description of the working class suffered from the inhumane treatment in economic, political, etc in early time, which leads to the principle of Soviet labor legislation, and put forward the claims of the protection of the working class by these principles, to pave the way for the following. The second part is the core of the dissertation, the basic content of Soviet labor legislation is described specifically and detailedly by a variety of data collection and analysis. Which are mainly include working hours and rest system, labor contract, wages, special protection of women workers, apprentices and child labor, labor disputes, the legal liability of breach of labor law, and so on. The third part is the characteristics of Soviet labor legislation, its revolutionary features, new characteristics and advanced features. The fourth part is the influence of labor legislation, mainly including the influence of Soviet, the Shaanxi-Gansu-Ningxia revolutionary region and the contemporary labor legislation. Getting the inspiration from it, the labor legislation should take social actual needs as the starting point and formulate feasible labor legislation. Which provide lessons and reference samples for the future of labor legislation. |
