The Economic Fraud Crime Management Research From The Perspective Of Social Legalinterest

China’s market economy unceasing development, at the same time, economic crime has gradually become a mainstream form of crime in modern society, the economic fraud crime as an important type of economic crime has become the largest and deepest serious among all kinds of economic crime. From the perspective of criminal law, the object of economic fraud violations of the infringement crime is a complex object. The crime of fraud against the economic law is not only the personal property law, including public credit and other social benefits. Crime control is a branch of the national governance system, which relates to the meaning of public management of social management and administrative management, including the crime prevention and control of the angle of criminology. From the perspective of Sociology of social rights protection perspective, no matter what kind of crime, economic fraud crime seriously violates social relations which state law protect. For government, the prevention and combat rising economic fraud crime has become a serious topic to be solved.Economic fraud crime is a new form of crime, and also a large number of types of crime, judicial practice have shown that this kind of case on the order of market economy of our country has great destructiveness and serious risks, therefore has caused the extensive concern of the criminal law of our country academia, criminology. Economic fraud is not only the judicial problems, the social harmfulness of national economic and social comprehensive management to the destruction and influence can’t be ignored. However, from the point of view of criminology, the crime has the existence and necessity, if the crime completely destroyed as a society under the rule of law of the ultimate goal and social governance purposes, it’s impossible and not scientific. The crime management is a branch of the national governance system, both procedural justice also has social significance, entity management and administrative division. The purpose of this paper is to the economic fraud crime control theory and practical analysis and research, in order to promote the modernization of national governance, to ensure the healthy and orderly development of the social and economic order, maintenance development, national economic safety, put forward effective suggestions.This paper is divided into five chapters:The first part mainly introduces the research background and significance, and the present situation the research in related fields both at home and abroad are reviewed, followed by the ideas and methods of this research, mainly uses the literature research method, empirical analysis method, theoretical analysis method and case analysis method.The second part is the theoretical analysis, mainly by starting from the analysis of the concept of crime of economic fraud, through the economic fraud crime, social legal interest theory and crime control theory, with the object of crime, the social benefits and social governance perspective on the economic fraud crime connotation and denotation of in-depth analysis and explain the social benefit and the economic fraud crime between theoretical logic relationship.The third part is the core part of this paper, nearly 5 years to Sichuan Province economic fraud case specific data analysis of display Sichuan Province Economic Fraud Crime development trend and specific governance effectiveness, analysis of the current situation of poor effect of this kind of case social governance. The current economic fraud crime management pointed out that in the traditional governance vicious circle (Governance--an increase in crime, strengthen governance--the crime surge dilemma, ’campaign style governance and object selectivity, tendency of amount of law enforcement problem and of the governance idea, environment and conditions of subjective and objective aspects of the reasons for analysis.The fourth part will from the judicial reality, to the Chinese public security organs in the economic fraud crime control in the presence of problems and faced enormous difficulties the origin and the root of to the modern theory of the crime control based, to maximize the realization of social protection of the interests of the law purpose, from the reform of the governance concept, optimizing the allocation of judicial resources, enhance governance and improve the evaluation mechanism of the perspective of innovative put forward to control the economic fraud crime countermeasures and suggestions.The fifth part is the conclusion, summarizes the full text, and the future research direction for the future.
