Deng Xiaoping’s Thought Of “Rule Of Law”

Since reform and opening up, "the rule of law" has always been a distinct theme throughout the development process in China.As the theoretical basis and guiding principle of the rule of law construction in China,the formation of Deng Xiaoping’s thought about the rule of law is of profound theoretical origin and the specific historical background.Deng Xiaoping’s thought about the rule of law is scientific and rigorous.It mainly includes the following several aspects:guaranteeing democracy and improving the legal system;establishing the authority of law;dealing with the relationship between the party and law correctly 、 the party and the government;putting forward the "one country, two systems”;adhering to an independent judiciary; carrying out the education of legal system.Under the guidance of Deng Xiaoping’s thought about the rule of law,China established the basic strategy of governing the country according to law and formed the constitution as the core of the legal system of socialism with Chinese characteristics.At present,China’s legal construction has made great achievements.But compared with the masses of the people are looking forward to and the target of construct "the country under the rule of law、the government under the rule of law、the society under the rule of law",the rule of law construction in China is still exist the following problems:the rule of law consciousness is not strong;legislation has a lot of problems;administrative law enforcement exist unfair phenomenon;the judicial system is imperfect;social corruption problems are more and more serious.To promote the Chinese construction of rule of law,the fourth plenary session of the 18 th CPC central committee firstly reviewed and adopted the "the central committee of the communist party of China on promoting the rule of law certain major issue decision" in the form of the plenum.In order to promote the rule of law,this session offered to uphold Deng Xiaoping Theory as the instruction to construct the socialist rule of law system with Chinese characteristics.As an important part of Deng Xiaoping Theory,Deng Xiaoping’s thought about the rule of law is not only the Marxism Theory of the rule of law with the combination of the rule of law practice in China, also is the theoretical basis and guiding principle of the rule of law construction in China.Therefore, adhering to Deng Xiaoping’s thought about the rule of law as a guide is important to the development of Chinese rule of law construction.How to solve the outstanding problems which existing in Chinese rule of law construction recently, the author thinks that from the following several aspects:our country should further improve the coverage of the rule of law publicity and education,and promote the rule of law publicity and education actual effect, and make the rule of law publicity and education work fall down on reality, and make the law become a faith to people;our country should perfect the legislation, and improve the quality of legislation, and promote the legislative democracy;our country should strict law enforcement,and clear division of administrative law enforcement responsibility,and establish and perfect the system of administrative enforcement discretion benchmark,and enhance the level of law enforcement officers,and perfect the system of administrative law enforcement;our country should further improve the judicial personnel professional consciousness,and strengthen the judicial information disclosure,and strengthen the independence of judicial system,and guarantee judicial justice;our country should make the national reporting system for civil servants of property income fall down on reality, and establish anti-corruption system on the basis of the inner-party democracy,and strengthen the outside supervision,and establish and improve the anti-corruption mechanism.
