In 2012, Japan unilaterally put forward to implement the proposal of "purchasing" Daoyu Islands and hoped to realize the "nationalization" of Diaoyu Islands by "purchasing". It not only severely infringed on China’s sovereignty, but also ruined the hope of "joint development" in the East China Sea. The demarcation in the East China Sea is a long standing issue that has been put aside for a long time by China and Japan. This issue left over by history can’t be solved only by negotiation between China and Japan, so that Japan will hardly quit the attempt of occupying Chinese territory. The long strained relationship between China and Japan is harmful to the long term, stable and sustainable development of China. At the same time, as one of the foundations of the human’s development, ocean possesses a great potential value and sovereign state long for it extraordinarily. After the United Nations Convention on the Law of the Sea was signed and come into force, the conflicts between coastal states has grew worse. As for the East China Sea issue, China wants to solve it by the way of equal negotiation and consultation. However, Japan holds an opposite attitude which makes the negotiation fall into a deadlock. In this thesis, the reasons that causing the issue of demarcation in the East China Sea will be dissected. And the different attitudes that China and Japan hold on the East China Sea issue will also be discussed. Furthermore, from the view of law, seek for the solutions to the issue of demarcation in the East China Sea. In the last, combined with the national conditions of two countries, analyze the future tendency of this issue.
