The Sixteen Party of the Communist Party of China clearly put forward the construction of socialist country ruled by law,The Eighteen Party of the Communist Party of China pointed out that the rule of law is the basic way of governing the country. To comprehensively promote the rule of law, currently the rule of law has become an important task. Country under the rule of law construction in addition to material basis, also need to require advanced the rule of law culture foundation.Cultural construction of rule of law not only needs to perfect legal laws and regulations, also need the value of spiritual guidance, it requires that the whole society especially the citizens to form a correct concept of the rule of law, only the rule of law as the pursuit of man’s inner consciousness, active, get the supreme authority of the rule of law, the rule of law value goal to achieve, can truly establish the country under the rule of law. Modern rule of law in China is weak, can say no before the rule of law,even if there is the rule of law is also a tool theory, emphasizes the legislation, strictly enforce the law and public law, ignore the value of the rule of law, as a result, people yearn for the rule of law and fear of the rule of law. The reason is that there is no set up a corresponding rule of law culture, too much emphasis on the rule of law of instrumental.
