Environment Pollution Tort Joint Liability Research Of Environmental Impact Assessment Institutions

With the rapid development of industry, the rapid phenomenon of environment pollution torts aggravate gradually. And as an important legal system of environmental impact assessment institutions-environment impact assessment institutions, jointly and severally liable with the enterprises entrusted by the joint tort problems also become increasingly hot topical. As environmental impact assessment institutions and entrust enterprise of joint and several liability system we article sixty-five of new environmental law, then sequential issued judicial explanation to explain this. Because of coarse law and unilateral judicial interpretation, its difficult to meet the needs of practice. Based on this, through the research on environmental common tort theory, the explanation of falsification in the new environmental law article sixty-five, as well as the situation and the environmental impact assessment institutions jointly and severally liable to assume situation, this paper tries to explore the joint liability of environment impact assessment institutions, in order to make up the existing legal gaps and the need of practice.
