“Locking Power In The Cage Of Institution”:The Study Of Power Alienation And Power Regulation

About power and its essence, academic has quite a lot dispute. But academic community generally believed that regarding power is related regime, legitimacy of ruling. Regulate power effectively can reduce the evil of human nature, provides political space for humanity to release the positive energy, lacking of power regulation, evil human nature releases the power of evil, and then evolves into political evil. From the ontological point of view, the essence of power is a kind of domination, which plays an irreplaceable role with its unique mandatory and publicity in maintaining social order and promoting social development, but principle power may have the problem of alienation in the process of the exercise of power because of the unequal,perish ability and expansionary. Along with our country enter the period of social transformation, the phenomenon of power dissimilation is becoming more and more popular. Problems of corruption were endless and intensified. At the second session meeting of 18 th Central Commission for Discipline Inspection congress, Xi Jinping put forward “locking power in the cage of institution ”, an important expound that enriches the content of statecraft in major issues concerning comprehensively advancing rule of law, pointed out the direction of solving the problem of power dissimilation.The essence of corruption is power alienation. This paper, through define the power and it’s alienation, combined transition period of China’s power alienation, analyses the causes of it. This paper points out of view, corruption attributed to power alienation, alienation of power due to the lack of institutional innovation, institutional arrangements, imperfect institution structure, implementation does not reach the designated goals and superficial concept of institution. According to the logic above, the paper presents the views that,“the key to guard against power alienation is to ?lock power in the cage of institution?”, “the key to ?lock power in the cage of institution? is to supervise political power”, “put managing official by law as the first place of rule of law and supervising power with system all-important”, “guards against ?wayward? power with the cage of system” etc. Through strengthening power restriction and power supervision, system anti-corruption can be finally actualized. Finally, the paper analyzes from strengthening the power of the main regulatory efforts, improve the institutional system of the statute of power, strengthening the rule of law regulatory power, creating regulatory powers and cultural environment demonstrate clearly how to “lock power in the cage of institution ”,and thereby form a complete set of countermeasures to curb the powers of alienation and corruption.
