On Completion Of The Management System For Judicial Identification In Our Country

With the development of science and the improvement of legal system, China has made considerable progress in the field of judicial identification, meanwhile it puts higher requirements to the management for judicial identification. The decision of The Standing Committee of the National People’s Congress on the issues concerning management for judicial identification was carried out in 2005, which is a symbol of the formation of the unified administration management system for judicial identification in our country, but it is hindered by the existence of defects in legal system in our country.According to the situation and defects of management system for judicial identification in our country, and based on our practical situation, this article draws on the experience of other regions and then puts forward some concrete proposals to complete the management system for judicial identification in our country. Firstly, analysis starts with the connotations of judicial identification to make them clear on the concepts as well as the natures, on the basis of the analysis, the contents of the management system for judicial identification are defined, with some related concepts are discriminated, while the necessity of completing our management system for judicial identification is analyzed. Secondly, this article argues that the relevant provisions of China’s current management system for judicial identification are not completed, and the decision is not fully implemented. Then, the article analyzes some concrete defects in the management system for judicial identification in our country, such as the disunity in the system of organization, not organized management mechanisms, the lack of limitations in the entrance requirements of justice identification, weakness in the management for practice activities, the lack of uniform procedures and standards, inadequate supervision and so on. Thirdly, in order to complete the management system for judicial identification in our country, this article studied and discussed the management systems for judicial identification in foreign countries so that to get some experience, which provided references to our completion. Finally, the article argues that some measures should be taken to complete our management system for judicial identification, such as to complete the relevant laws and regulations, to perfect the unified system of organization, to perfect the organized management mechanisms, to improve the limitations of the entrance requirements of justice identification, to strengthen the management for practice activities, to unify the procedures and standards, and to strengthen the supervision of the judicial identification activities, and so forth.
