Tourism is an important branch of modern service industry,which is called "eternal sunrise industry".Since 1990’s,international tourism played an increasingly important role in global trade and services sectors. With the rapid development of international tourism, its desire for market expansion will become more intense, we need to form a unified, standardized international tourism services market, while the global unified standard market demand liberalization. International tourism service trade liberalization is the trend of the industry. Tourism plays an irreplaceable role in promoting the opening and liberalization of services trade at the beginning of China’s accession to WTO. This paper focuses on the service trade liberalization, which firstly analysis the tourism trade in services under the GATS framework and the status of international tourism services trade in China. And according to the new practice of FTA in promoting international tourism services trade, the author introduce and analysis some advanced practice which has a high degree of trade liberalization. In the implementation of Pilot Free Trade Zone, China should raise the opening level of tourism service trade, improving our legal system on tourism, in order to promote tourism service trade liberalization.The first chapter is an overview of the international tourism services trade. In the beginning, the definition of service trade are described, what follows is the definition of international tourism service trade.Next the author explain the legal characteristics of international tourism service trade. Then introduces and analyzes the open rules of international tourism service trade, it is necessary to allow exceptions to liberalization. To better understanding the legal sources of international tourism service trade, the author explains the different stages of evolution about the international law system from the perspective of international law.The second chapter describes the status quo of China’s tourism service trade legislation and the main content. This part from the cross-border supply, consumption abroad, commercial presence and movement of natural persons as defined four types of services trade in GATS. Then we discuss China’s WTO commitments and fulfill conditions. In addition to China’s WTO commitments, introduced China’s tourism service trade legislation.Combined with the signature of the Free Trade Agreement, which related to tourism service trade is introduced.The third chapter describes the practice of the international tourism services trade in FTA. Doha Round negotiations stalled, WTO in promoting liberalization of services trade is increasingly feeble, while the regional and bilateral free trade agreements as a new impetus. Strengthen the construction of FTA is the necessary measures to comply with regional(bilateral) services trade liberalization trend. The author describes the practice of Singapore promote tourism service trade liberalization under the multilateral mechanism, bilateral free trade agreements.Then analyze its domestic laws and policies to promote tourism service trade liberalization.Chapter IV describes the law path of tourism service trade liberalization. Tourism has become popular worldwide life and business methods, while the exports proportion of tourism services trade in China needs to be improved. The author propose rational using of two wheels,which are multilateral liberalization of services trade and regional(bilateral) services trade liberalization,so as to improve the tourism legislation and rise the standard of tourism service trade liberalization.
