Nowadays, tourism has become the world's First industry. After been developed for more than 20 years, tourism service trade has been the mainstay industry of Chinese foreign exchange-earning enterprises, playing a more and more important role in the growth of our national economy. While entering the World Trade Organization, China surely has to apply the basic principle and responsibility in GATS.GATS brings Chinese tourism service trade a fair, non-discriminate competition opportunity and a broader foreground, but also brings a stricter request and higher respect. Under the WTO system, the problems of Chinese tourism service trade legal system become even more obvious. Through analyzing the effect on Chinese tourism service trade legal system caused by GATS and the problems in this system, this thesis attempts to put forward relevant legal suggestions, in order to perfect Chinese international tourism service trade legal system and to provide an instructive idea for further development of Chinese international tourism service trade.This thesis sets out in three chapters, except the preface and the conclusion.The first chapter introduces briefly the basic principles and obligations in GATS and the commitment of China's Entry into WTO in tourism service trade.The second chapter focuses on the effect on Chinese tourism service trade legal system caused by GATS. This chapter analyzes the effects from two different aspects: the good effect and the pressure or challenge. To improve China's tourism management system and its legal system have been a vital issue.The third chapter puts forward some suggestions for perfecting Chinese tourism service trade. To deal with the pressure and challenge faced by Chinese tourism service trade, this paper points out five practical suggestions: improving Chinese tourism management system, building international tourism enterprise group, persisting in reasonable open strategy in negotiation, enhancing bilateral or multilateral cooperation and improving tourism service trade legal system. A recent significant task is to build a non-discrimination, transparent and open tourism legal system.
