Tourism is called as"everlasting sunrise industry". Since 1990's, international tourism service trade has become one of the most-powerfully-developing industries in the world. With the further development of international tourism, it is an inevitable trend that tourism service trade among different countries comes into liberalization. Tour industry has been the leading industry in the process of opening-up, and has been playing an irreplaceable role in promoting national economic development and liberalization of service trade. This article, concentrating on the aim of GATS—gradually promoting liberalization of international service trade, analyzes the present situation of tourism liberalization in China under the framework of GATS, and put forward some ideas that we should gradually enlarge the unopened areas in tourism trade, continuously reduce barriers in entry-exit of international travelers, build and perfect our country's laws and regulations system of in tourism.The first chapter generally introduces international tourism service trade. In the beginning, the definition and classification of international service trade are described, what follows is the legal characteristics of international tour service trade, and the last part of this chapter is the analysis of trade barriers in international tourism and its relationship between liberalization. The second chapter discusses the application of GATS rules in Chinese international tour service trade. The author introduces the content of international tour service trade and the level of tourism liberalization in China based on analyzing the four types of service trade: cross-border supply, consumption abroad, commercial presence and movement of natural persons.The third chapter is about some legal problems occurred in the course of international travelers'entry-exit. After discussing the legal basis (free right to travel) and general act of entry-exit, the author centers on some restriction measures of China and proposes the broader application of mutual exemption of visa, especially in CAFTA.The last chapter inquires how to improve the tourism laws in China. There exist many problems and defects in present travel laws and regulations. Therefore, in the purpose of learning from others, the author introduces several countries'legislative modes in tourism, and finally offers some suggestion on formulation of Chinese travel law from the perspective of promoting the liberalization of international tour service trade.
