With the development of network in our country, network is becoming one important way of civil information exchange in recent years. But everything has two sides, the network in promoting the exchange of information, also filled with some negative factors.Specific say, it is the emergence of Internet reputation crimes. This crime is a new form of expression of traditional reputation crime under the network space,and the further expansion of network space.The characteristics of network, makes network reputation crimes produced many new problems. First, in terms of the concrete determination of the crime, how to distinguish with other similar charges. Secondly, in terms of specific practice, how to choose public prosecution and private prosecution,and how to define jurisdiction. Finally, at the same time of regulating internet reputation crimes, how to balance the freedom of speech.This paper, from the perspective of comparative study, literature research and case studies,respectively, aiming at the above problems puts forward the solution of the targeted measures, so as to provide reference for theory and judicial practice. Specifically, this paper will be divided into four parts, the first part: making a holistic overview for Internet reputation crime, and conducting a comb respectively from its connotation, the performance of the existing legislation. The second part: analyzing the several major problems existing in the current network reputation crimes, in turn, it is discussed the issues involved, problems of practice and the balance between freedom and reputation protection problem. The third part:discussing the extraterritorial legislation experience,in view of the problem in the second part, and drawing beneficial ingredient from the United States, Britain, Germany, Taiwan region’s legislative. The fourth part: giving the suggestion to solve and consummate the problems according to the above problems, from the perspective of theory and practice.The author finally concluded that most problems don’t need a legislative changes, only by legislative reinterpreted.
