Research On Problems Of Petition Involving Law And Litigation In Discipline Inspection In Huidong

The number of petition cases involving law and litigation brought to discipline inspection departments at all levels has increased year by year, with the tendency of skipping,group, multiple and disturbing appealing. Some cases have been announced by Supreme People’s Court or even closed by the political and law system, however,the compliant makers continue petitioning and some petition their whole life. They submit proposals to various departments every day, demanding solution to their problems, which has become a serious social issue. Petition involving law and litigation is related with judicial independence and authority, so discipline inspection departments at all levels tend to hand over cases to.related departments such as complaint and supervision divisions within People’s Congress, Politics and Law Committee as well as public security organs, leaving very few to themselves.Meanwhile, complaint letters sent to discipline inspection departments often have something to do with party cadres’ disciplinary violations and livelihood appeals, which is relatively complicated, and systematic procedures haven’t been established.The essay introduces current situation of petition involving law and litigation in discipline inspection, classifying and analyzing causes and problems to draw conclusions to advantages of systematic procedures, which is the solution to job carrying out and monitoring.Research methods including case study, qualitative and quantitative analysis are used to define petition involving law and litigation, analyzing its connotation, extension, orientation and function. It analyzes causes and practical problems by studying Huidong County,Guangdong Province to draw conclusions to advantages of systematic procedures. The study shows that petition involving law and litigation will exist for a long time. Discipline inspection system is important for anti-corruption and supervision, and we shall not allow no flexibility regarding judicial independence and authority of public security organs. Instead, we shall improve the system for refinement and classification to guarantee judicial independence as well as authority and better performance of supervision as well as anti-corruption of discipline inspection system.
