Research Of Administrative Assistance Legislation In China

Today, the theory of administrative law and the rule of law are developing rapidly, and the division of national administrative authority is more clearly fine, and social practices affairs are increasingly complex. Administrative assistance is a way to help each other between the administrative body, regardless of the administrative body for the administration, or to protect the interests of the counterpart have great significance. Extraterritorial administrative assistance system is more mature in theoretical research and legislation, but we have no currently established unified system of administrative assistance. However, there are lots of administrative assistance phenomenons in practice. Due to the lack of unified legislative guidance, the practice is not standardized. Currently, scholars have made a lot of study in the range of administrative assistance, the occurrence of conditions, and the extraterritorial regime. Based on previous studies, this paper intends to study the system of administrative assistance more comprehensively, we hope that it can help to the theory of administrative and legislative assistance. The thesis includes five chapters. First of all, we introduce the background, significance of administrative assistance systerm, current research, and research methods in the introductory section briefly. Next is the administrative assistance of content sections. In the first chapter, we expound the basic overview of administrative assistance, include the concept, characteristics, and the classification of administrative assistance, and related concepts. In the second chapter, we discusses the theoretical basis and functional of administrative assistance system, elucidates the basis for the rationalization of administrative assistance system. In the third chapter, we describes the status of the legislation and practice of administrative assistance system, and analysis the existing issues of legislation and practice, such as legislative gaps, poor handling, lack of supervision, lack of hardware facilities, and so on. In the fourth chapter, we explore the inspiration to build our administrative assistance system through the extraterritorial administrative assistance legislation. In the fifth chapter, on the basis of the above all, we make some reasonable suggestions to build on the legislative system of administrative assistance on the selection the macro of the legislative model, the detail content of the specific system design. I hope that it can help to build China’s administrative system.
