| Children’s rights and the protection of children are becoming a hot spot paid attention from all people,and the idea and the practice of childrens’ s protection are developing in China in recent years. But at present, our country still exists the phenomenon that the children’s right is always violated,especially the street children.Away from the guardian and wandering through streets, Street children suffer from any damage of the outside world, even the basic life being difficult to sustain and fundamental rights lack of protection.Administrative assistance for street children is the behavior for administrative subject of Responsible for the duty to rescue and help the street children. The study of the system of administrative assistance for street children is based on the perspective of this kind of main body-the street children and study the system of administrative assistance.Relying on the construction of the system of administrative assistance,the street children’s basic right should have be protected.In this paper, the first part are the basic theory of street children and the basic theory of the system of administrative assistance for street children. From the scope of the definition of the street children,the causes to the street children and lack of basic rights of the street children, this paper expounds the current situation that the street children’s rights are serious violated. Because of the right for livingand right for education and employment closing to the right for living rights being a great threat for street children,the paper put forward to rescue as soon as possible.It lays the starting point of the full text and matting that is the concept of administrative assistance for the street children, the necessary content and the analysis of the nature, which undertakes the first part. The paper mainly discusses the theoretical basis of administrative assistance for the street children and puts forward the theory of the right for living that is necessary to build the system of the administrative assistance for street children, and carries the contract theory that is the origin of administrative subject to rescue the street children for their duty, besides the idea of service administration is also to emphasize the degree and attitude of administrative subject for rescuing the street children. Three theories support theoretical basis of the paper. However the law is the origin of obligation for administrative subject to rescue the street children and provides legal basis of administrative assistance for the street children. In the second part, the paper mainly analyze the events for the construction and practicing of the system of administrative assistance for street children, and then puts forward problems of the administrative assistance for the street children in law and the in the process of practice. Aiming at the problem of the second part in the third part, the paper push for studying for countermeasures and put forward to improve the law for the first step, and to design a new program to form a complete set,Besides improving the system of guardianship and adoption for the street children, pushing for the cooperation with the social organization, which can protect the basic right of the street children to prefect the system of administrative assistance for the street children. |
